Member’s Fraudulent Inducement of Capital Contribution Claim Fails

On behalf of a member/manager, we defeated a claim on summary judgment that he violated his fiduciary duty under Delaware law by fraudulently inducing his co-member to invest more capital into a failing business venture. Marsala v. Mayo, 2007 WL 3245434 (E. D. La. Judge Feldman Nov. 2, 2007).
