Defense Verdict for Catastrophic Injury Claims Asserted Under Federal Employers Liability Act (FELA)

Joyce Gist Lewis won a unanimous defense verdict in a state court jury trial in which the Plaintiff, alleging that his FELA employer’s negligence caused him to suffer permanent injuries to his spine which would limit his ability to work for the remainder of his life, sought damages in excess of $1 million. Following a cross-examination of the Plaintiff and his expert in which Joyce demonstrated that Plaintiff’s work did not cause his injury, the jury returned a full defense verdict in less than one hour.
