Entire Fairness Defeats Fiduciary Duty Claims In Arbitration
Halsey Knapp and Adam Sparks obtained a complete defense award in arbitration proceeding initiated by client’s sibling based on allegations that our client, an investment advisor, violated fiduciary duties when discharging his duties as manager of a family limited partnership and trustee of related generation skipping trusts. We successfully demonstrated the entire fairness of the client’s decisions to retain his own firm to diversify its holdings, to manage the ensuing complex portfolio of assets for a fee and to invest a share of the eight-figure portfolio in projects nominally affiliated with our client.
